1, Process Explication:

2, Your Refugee Claim May not be Eligible for Referral to IRB if
- You have been recognized as a Convention refugee by another country to which you can return;
- You have already been granted protected person status in Canada;
- You arrived via the Canada-United States border;
- You are not admissible to Canada on security grounds, or because of criminal activity or human rights violations;
- You have been convicted of a serious crime;
- You made a previous refugee claim that was found to be ineligible for referral to the IRB;
- You made a previous refugee claim that was rejected by the IRB; or
- You abandoned or withdrew a previous refugee claim.
- You are subject to a removal order
3. Transfer the claim: Check if Your Claim is not Eligible
Before the start of the refugee claim, please check if your claim is eligible;
If your claim is not eligible, you’ll be issued a removal order;
If your claim is eligible, If the officer from IRCC decides that your claim is eligible, your claim will be referred to the RPD, and you will be given a Confirmation of Referral.
4, Then you proceed for hearing. During the waiting period, you could apply for work permit
5, Understand key concepts:
Convention refugees are people who are outside their home country or the country where they normally live, and who are unwilling to return because of a well-founded fear of persecution based on:
- race;
- religion;
- political opinion;
- nationality; or
- membership in a particular social group, such as women or people of a particular sexual orientation.
- Person in need of protection
A person in need of protection is a person in Canada whose removal to their home country or country where they normally live would subject them personally to:
- a danger of torture;
- a risk to their life; or
- a risk of cruel and unusual treatment or punishment.

- Original of all identity and relationship documents, (if not in English or French, translation needed)
- 4 passport-size photos of yourself and family members in last 6 months.(name and DOB must be printed clearly on the back of one of the photo)
- Other documents to support your refugee claim (if not in English or French, translation needed)
7. Results
RPD conferred your refugee status, and you become a protected person in Canada, you will have permanent residency in Canada. If RDP refuses your refugee application, you could appeal for RAD. Refugee Appeal Division. Another scope of service and fees will be drafted in another retainer agreement.
